  1. Acceptance of Terms
    These Terms of Service (“Terms”) govern your access to and use of the websites, portals, content, products, and services offered by OmniSure Consulting Group, LLC (“OmniSure,” “we,” “us,” or “our”) (collectively, the “Services”).   • You retain ownership of content you submit, upload, or transmit through the Services (“User Content”). You grant OmniSure a nonexclusive, worldwide, royalty‑free license to host, store, reproduce, modify (for formatting/display), and display User Content to operate and improve the Services.
  • You represent that you have all rights necessary for your User Content and that it does not violate law or third‑party rights.

  • The Services may contain links to third‑party websites, platforms, tools, or services. We do not control and are not responsible for third‑party content or practices. Your use of third‑party resources is at your own risk and may be governed by separate terms and policies.

Unless expressly stated in a separate signed agreement, Services are provided for general informational purposes and are not legal advice.   1. Messaging Terms & Conditions (SMS)
    Program name and brand
  • OmniSure Consulting Group, LLC (“OmniSure”) operates SMS/text messaging programs under the OmniSure brand for eligible users who opt in.

Message types you may receive

  • Depending on your opt‑in, messages may include: customer care/support communications; appointment reminders, confirmations, and scheduling notices; account or service notifications; security or verification prompts; and occasional marketing or promotional messages related to OmniSure’s services.

Message frequency

  • Message frequency varies by program and user activity, including reminders around scheduled appointments, service notifications, and periodic marketing campaigns.

Opt‑in consent

Opt‑out instructions

  • You can opt out at any time by replying STOP. After you text STOP, you will receive a one‑time opt‑out confirmation and no further messages will be sent to your number unless you opt back in (e.g., by texting START/UNSTOP or completing a new opt‑in).

Eligibility and carrier disclosure

  • Program availability depends on supported U.S. carriers and network coverage. Delivery is subject to your carrier’s network capabilities; OmniSure is not responsible for delayed or undelivered messages.

  1. Limitation of Liability
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMNISURE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO SOME LIMITATIONS MAY NOT APPLY.

  • You agree to defend, indemnify, and hold harmless OmniSure, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services, your User Content, or your violation of these Terms.

  • You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. embargo or sanctions and are not a prohibited person under applicable export or sanctions laws. You agree to comply with all applicable import, export, and sanctions laws and regulations.
  1. Suspension and Termination
  • We may suspend or terminate your access to the Services for any actual or suspected violation of these Terms or applicable law, or for conduct that may cause harm or liability to OmniSure, users, or third parties.
  1. Governing Law; Venue
  • These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑laws principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas for all disputes arising out of or relating to these Terms or the Services.
  1. Dispute Resolution; Arbitration (Optional)

  • No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms without restriction in connection with a merger, acquisition, corporate reorganization, or sale of assets.
